GDPR Email Signature Disclaimer: What to Include (With Templates)

If you send business emails from the European Union, your email signature probably needs a legal disclaimer. The requirements vary by country, but the general rules are clear. Here is what you need to include and ready-to-use templates you can copy right now.

What is Legally Required?

EU regulations require commercial emails to identify the sender. At minimum, your email signature should contain:

  • Full company name (as registered)
  • Registered office address
  • Company registration number
  • VAT number (if applicable)
  • Name of the managing director(s) or responsible person

This is not just a GDPR thing. These requirements come from EU e-commerce directives, national commercial codes, and company law. GDPR adds the privacy layer on top: if you process personal data (and email addresses count), you need to inform recipients about their rights.

When Do You Need a Disclaimer?

The short answer: always, for business emails. The long answer depends on your situation:

  • Limited companies (SA, SARL, BV, GmbH, Ltd): Required by law. Most EU countries mandate company identification in all business correspondence, including emails.
  • Freelancers and sole traders: Required in most EU countries. You need at least your legal name and business address.
  • Internal emails: Generally not required, but many companies include a confidentiality notice anyway.
  • Personal emails: Not required.

Country-Specific Templates

Belgium

Belgian company law (Code des Societes et des Associations) requires the following in all outgoing correspondence:

Germany

German law is the strictest. Every commercial email must include (per HGB and GmbHG):

Geschäftsführer: [Managing Director Name(s)]
USt-IdNr.: DE[VAT number]

Germany specifically requires the name of the managing director(s). Omitting this can result in fines. If you have multiple directors, list all of them.

Adding a Privacy / GDPR Notice

Beyond company identification, GDPR suggests (but does not strictly require) a privacy notice in email communications. A practical approach: add a short line linking to your privacy policy.

Privacy: This email may contain confidential information. If you are not the
intended recipient, please delete it and notify the sender.
Privacy policy: [link to your privacy policy]

Keep the disclaimer brief. Two to three lines in a smaller font size (10-11px). Long legal blocks at the bottom of every email are rarely read and make your signature look cluttered.

Formatting Tips

  • Use a lighter text color (gray, not black) for the disclaimer to visually separate it from your main contact information.
  • Use a smaller font size: 10px or 11px works well.
  • Place the disclaimer below a horizontal separator line.
  • Link your privacy policy rather than including the full text. Nobody reads a 500-word privacy policy pasted into an email signature.
